1-5-11 — The father charged with assaulting his six-week-old son has been indicted by the Wayne County Grand Jury. During a session held on Tuesday, December 21, Zachary Wiater was indicted for first degree assault and criminal abuse first degree.
The charges stem from an incident that occurred October 26, when police say the infant was taken to the local hospital for treatment of injuries. Police and social services were called in to investigate, after doctors indicated that the injuries were suspicious in nature, according to testimony provided during a preliminary hearing in the case last month.
Wiater was arrested on November 6 in Fayette County, where the baby was hospitalized at the time. He has been lodged in the Wayne County Detention Center since November 10. Bond has been set at $20,000 cash.
Also during the session, the grand jury returned 16 other open indictments. They included:
• Jimmy L. Brummett was indicted for burglary second degree and persistent felony offender first degree.

The grand jury also returned 15 sealed indictments. The names of individuals included in sealed indictments are not released to the public until arrests have been made.
Readers are reminded that grand jury indictments do not indicate guilt, only that further court action is necessary in a case. Grand jury indictments are public record in the Wayne Circuit Clerk's Office.
