Fiscal Court tries to recover costs from delay of Justice Center
Melodie Phelps
News Editor

Wayne County Fiscal Court has authorized County Attorney Lee Tobbe to

file an arbitration action against International Fidelity Insurance Company

in an effort to recover about $155,000, the cost of a lengthy construction

delay on the new Justice Center.

Tobbe told magistrates during a meeting on Thursday, December 8 that the

insurance company actually provided the bond for the bricklayers contracted

for the Justice Center project.

The bricklayers left the site before that portion of the work was

completed and caused a five to six month delay in completion of the project.

That company has since filed bankruptcy, according to Tobbe. He has been

in negotiations for several months with International Fidelity Insurance

Company to reach a settlement for the construction delay, but noted that

negotiations have not moved along smoothly.

In other action during the meeting, the court awarded the bid for the

cleanup of 10 illegal dump sites in Wayne County to Gene Higginbotham.

Higgin-botham's bid of $19,550 was the lowest of three submitted for the

cleanup.

Solid Waste Coordinator Andrew Parmley also told fiscal court that the

door-to-door white goods pickup is continuing. So far, items have been

picked up at 170 households in different communities around Wayne County.

County officials announce in advance communities slated for the next

collection effort and anyone who wants to dispose of white goods and large

household items can call and schedule a pickup.

In other action, the court:

*Agreed to remove the Claude Denney Road in District Three and Bestview

Estates in District Four from the county road system.

*pproved the second reading of an ordinance amending the budget to

include $207,200 in unbudgeted receipts in various funds.

*Approved the Sheriff's budget and salary allotment for 2006.

*Approved the County Court Clerk's budget and salary allotment for

2006.

*Approved the appointments of Pauline Neely, Mark Massengale and Ilene

Kenney to the Extension Council.

*Heard a monthly report from Jailer Ray Upchurch who said that total

inmate population at the Detention Center was 167. That includes 101 state

inmates and 66 county inmates.

Upchurch said that the Department of Corrections has been billed

$105,048.52 for housing state inmates for the month of November. Several

other counties are also housing inmates in Wayne County, and total billing

for the moth was $110,498.52.

*Heard a monthly EMS report from Director Bubby Corder. Corder said EMS

has answered 2,978 calls so far this year. He noted that both the four-wheel

drive vehicles are prepared in case of bad weather. Also, EMS expects to

receive a grant that would purchase six laptop computers to be placed in

ambulances.
